Terms of Service

These Terms of Service ("Terms") govern your use of this website and your purchase of advertising services from The Local Loop ("we," "us," or "our"). By submitting an inquiry, reserving or purchasing an advertising spot, or providing advertising materials, you agree to these Terms.

Our service

We sell advertising placements on shared direct-mail pieces and related campaign pages. The campaign page, order summary, invoice, or written proposal describes the placement, price, estimated audience, production schedule, and other terms for a particular campaign. If those specific terms conflict with these Terms, the specific campaign or order terms control.

Business authority

You represent that you are at least 18 years old and have authority to act for the business identified in your order. You are responsible for accurate contact, billing, and business information.

Reservations and payment

A placement is not guaranteed until we confirm it and any required payment is completed. Prices are shown before purchase and may include or exclude taxes as stated at checkout. Payments may be processed by Stripe under Stripe's terms and privacy policy. You authorize us and our payment providers to charge the amount shown for the selected placement and any later amount you separately approve.

Artwork, deadlines, and approval

You must provide usable artwork, copy, logos, offers, approvals, and other requested materials by the stated deadlines. You grant us and our production providers a non-exclusive license to use, reproduce, resize, adapt, print, distribute, and display those materials as needed to fulfill the campaign and show the resulting advertisement in campaign records or portfolio materials, unless we agree otherwise in writing.

You represent that you own or have permission to use everything you submit and that it is accurate, lawful, and does not infringe another person's rights. You are responsible for reviewing proofs and promptly reporting errors. We may reject or require changes to material that is unlawful, misleading, offensive, technically unsuitable, or inconsistent with the campaign.

Production and distribution

Mail dates, delivery windows, quantities, routes, and audience figures are estimates unless we expressly guarantee them in writing. Printing, postal processing, weather, carrier operations, and events outside our reasonable control may cause changes or delays. Advertising results vary; we do not guarantee responses, leads, sales, revenue, or any other business outcome.

Cancellations and refunds

The cancellation, credit, and refund terms shown for your campaign or order apply. Unless those terms say otherwise, fees become non-refundable once design, production, printing, or other committed work begins. Nothing in these Terms limits a right that cannot legally be waived.

Acceptable use

You may not misuse the site, interfere with its operation, attempt unauthorized access, submit malicious code, impersonate another person or business, or use the service for unlawful, fraudulent, deceptive, or infringing advertising.

Third-party services

This site may use or link to third-party services, including payment, mapping, analytics, hosting, and delivery providers. Their services are governed by their own terms and policies. 9x12 Tools provides website technology to us but is not the seller of your advertising placement and is not a party to your agreement with The Local Loop.

Disclaimers

To the fullest extent permitted by law, the site and services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free site operation or any particular advertising result.

Limitation of liability

To the fullest extent permitted by law, The Local Loop and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our total liability arising from a campaign or order will not exceed the amount you paid us for that campaign or order. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The Local Loop and its owners, employees, contractors, and service providers from third-party claims, damages, and reasonable costs arising from materials you submit, your advertisement, your violation of these Terms, or your violation of another person's rights.

Changes and general terms

We may update these Terms for future use of the site or future orders. The version accepted with an existing order continues to govern that order unless we agree otherwise. If a provision is unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision is not a waiver.
